Public Offer for Provision of Information Services

This document constitutes an official public offer (“Offer”) in accordance with the legislation of the Republic of Serbia and is addressed to individuals and legal entities wishing to use the services of the Internet Portal https://grailgun.ai (the “Service”, “Portal”).

Individual Entrepreneur Milana Mikhailovna Fedotova, registered under the laws of the Republic of Serbia (registration number: 67981804, address: Tikveška 19, Voždovac, Belgrade, 11050), acting as a sole proprietor (“Owner”), hereby offers any capable individual or legal entity (“User”) to enter into this Agreement under the terms below.

1. Definitions

1.1. Offer — this document published at https://grailgun.ai.

1.2. Acceptance — full and unconditional acceptance of this Offer through payment for services or by starting to use the Service.

1.3. Service — the website https://grailgun.ai and the associated software tools, including:

• messenger bot builder;
• tools for collecting, processing, and transmitting messages;
• integrations with third-party services (where available);
• access from Telegram, WhatsApp, Viber, and other supported messengers;
• technical support.

1.4. User — a person or entity who has accepted this Offer.

1.5. Administration / Owner — Individual Entrepreneur Milana Mikhailovna Fedotova.

2. Subject of the Agreement

2.1. The Owner provides the User with access to the Service’s functional capabilities, including:

• creation and configuration of bots for various messengers;
• automatic message collection and delivery;
• integrations and third-party service connections;
• access to analytics and automation tools;
• technical support within the scope described on the Portal.

2.2. Access to the Service is granted after messenger-based authorization. Registration on the Portal occurs automatically using the User’s messenger account data.

2.3. The User undertakes to:

• ensure the accuracy of their personal and payment data;
• not transfer access credentials to third parties;
• comply with applicable legislation.

3. Acceptable Use Policy (Prohibited Activities)

3.1. The User agrees NOT to use the Service for any of the following purposes:

Spam

Sending unsolicited bulk messages, advertising, or spam in violation of the recipients’ consent or messenger platform rules.

Illegal Content

Promoting illegal goods, drugs, weapons, violence, sexual content, hate speech, or discrimination.

Fraud

Phishing, identity theft, or collecting sensitive personal data (e.g., passwords, financial data) without user consent.

Platform Violation

Actions that violate the Terms of Service of third-party platforms (Telegram, WhatsApp, Viber, etc.), including unauthorized scraping or bypassing restrictions.

3.2. The Owner reserves the right to automatically moderate outgoing content from bots created by the User. In case of violations are detected, a manual review may be initiated.

3.3. The Owner reserves the right to immediately suspend or terminate the User’s account or a specific bot without refund if any violation of this section is detected.

3.4. The User acknowledges that they are solely responsible for the content of messages sent via the Service.

4. Acceptance of the Offer and Changes

4.1. Acceptance is performed via payment for services or use of any functional part of the Service.

4.2. The User must familiarize themselves with this Offer prior to Acceptance.

4.3. The Owner may change the terms of this Offer unilaterally. The updated version is published on the Portal and becomes effective immediately.

4.4. By accepting the Offer, the User confirms being over 18 years of age and legally capable.

4.5. This Offer must be read together with the Privacy Policy. In case of discrepancies, the Offer prevails.

5. Financial Terms

5.1. All conditions related to refunds, cancellation of recurring payments, and procedures for submitting claims are governed by the separate Refund Policy, which is published on the Service at https://grailgun.ai/refund/ and is an integral part of this Offer.

6. Termination and Suspension

6.1. Either party may terminate this Agreement unilaterally. The User terminates the Agreement by cancelling the subscription.

6.2. Termination does not affect the validity of payments already made.

6.3. The Owner may suspend access to the Service if the User violates the terms of the Offer, specifically Section 3 (Acceptable Use Policy).

7. Limitation of Liability

7.1. The Owner is not responsible for:

• failures, downtime, or data loss caused by messenger platforms (Telegram, WhatsApp, Viber, etc.);
• blocking or banning of the User’s messenger accounts by third-party platforms due to the User’s activity or violation of their rules;
• actions of third-party service providers and integrations;
• incorrect bot configuration by the User;
• lost profits or indirect damages.

7.2. The Service is provided on an “as is” basis without guarantees of uninterrupted operation.

8. Final Provisions

8.1. The governing law is the legislation of the Republic of Serbia.

8.2. Disputes shall be resolved through negotiation, and if unresolved, through Serbian courts.

8.3. The version of the Offer published on the website at the moment of usage is considered valid and binding.

If you do not agree with the terms of this Offer, you must cease using the Service and leave the website.
